These Terms of Service ("Terms") govern your use of the Lake Country Septic Services website at lakecountrysepticservices.ca (the "Website"). Lake Country Septic Services is a trade name operated by Ontario Lead Networks ("we," "us," or "our"), a sole proprietorship based in Ontario, Canada.
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Website.
1. Nature of Our Service
Lake Country Septic Services is a referral and lead generation service. We are NOT a septic contractor.
We operate a website that allows homeowners to submit requests for septic services (pumping, inspection, repair, installation, and related services). When you submit a request, we forward your information to a licensed septic contractor in your area. That contractor contacts you directly to discuss your needs and provide a quote.
We do not:
- Perform any septic work ourselves
- Employ, direct, or supervise any contractors
- Set pricing for any septic services
- Guarantee the quality, timeliness, or outcome of any contractor's work
- Act as a party to any agreement between you and a contractor
2. No Guarantee of Service
While we make reasonable efforts to connect you with a qualified contractor, we do not guarantee:
- That a contractor will be available in your area
- That a contractor will contact you within any specific timeframe
- The quality, accuracy, or completeness of any contractor's work, advice, or quote
- The licensing, insurance, or certification status of any contractor
- That the contractor's pricing will be competitive or reasonable
You are responsible for verifying a contractor's credentials, insurance, licensing, and suitability for your project before hiring them. We encourage you to request proof of licensing and WSIB coverage from any contractor before work begins.
3. Independent Contractor Relationship
The contractors to whom we refer your request are independent third parties. They are not employees, agents, partners, or subcontractors of Lake Country Septic Services or Ontario Lead Networks. We do not control, direct, or supervise their work in any way.
Any agreement you enter into with a contractor is strictly between you and that contractor. We are not a party to that agreement and bear no responsibility for its terms, performance, or outcome.
4. Consent to Information Sharing
By submitting a request through our contact form, you consent to having the personal information you provide (name, email, phone, location, service type, and message) forwarded to a septic contractor in your area for the purpose of providing you with a quote.
Your information will be handled in accordance with our Privacy Policy and Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- Lake Country Septic Services and Ontario Lead Networks shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Website or any contractor's services.
- We are not liable for any property damage, personal injury, economic loss, or environmental damage resulting from work performed by a referred contractor.
- We are not liable for any contractor's failure to perform, delay in performance, or breach of any agreement with you.
- Our total liability, if any, shall not exceed the amount you paid to use our service (which is zero, as our referral service is free to homeowners).
6. Indemnification
You agree to indemnify and hold harmless Lake Country Septic Services, Ontario Lead Networks, and their owner, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Website
- Any dispute between you and a contractor referred through our service
- Your violation of these Terms
- Your violation of any applicable law or regulation
7. Accuracy of Information
The information on this Website is provided for general informational purposes only. While we strive to keep the information accurate and up to date, we make no warranties or representations about the completeness, accuracy, reliability, or suitability of any information on the Website.
Content on the Website, including blog posts and service descriptions, does not constitute professional advice. Always consult a licensed septic professional for advice specific to your situation.
8. Intellectual Property
All content on the Website — including text, graphics, logos, icons, and design elements — is the property of Ontario Lead Networks or its licensors and is protected by Canadian copyright law. In the event of any dispute arising from or relating to these Terms or the services provided through this Website, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of Ontario.
For disputes between you and a contractor referred through our service, we encourage you to first attempt to resolve the matter directly with the contractor. If the contractor is a licensed tradesperson, you may also contact the relevant Ontario regulatory body or your local consumer protection office.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lake Country Septic Services regarding your use of the Website.
